This is a motion brought by defendant SMEC, Inc., to dismiss this action for improper venue or, in the alternative, to transfer the case to the Middle District of Tennessee. The original complaint was filed on December 23, 1981, and it alleged infringement by defendant of U.S. Letters Patent No. 4,261,339 (’339 patent). On May 4, 1982, U.S. Letters Patent No. 4,327,709 (’709 patent) was issued to plaintiff for a medical device closely related to the device covered in the earlier patent.
