FERGUSON, Judge:

This case is before us for review the second time. In our initial opinion (United States v Robbins, 16 USCMA 474, 37 CMR 94), we reversed for an instructional error by the law officer, and for his ruling excluding certain testimony during the sentence proceedings. The record of trial was returned to the Judge Advocate General of the Army for further proceedings. In our mandate thereon we advised the Judge Advocate General that “such proceedings be had in said case as will cause the convening authority to order a rehearing, if such rehearing is practicable; and, such…
