The accused, Bernard Gerald Gordon, was initially charged with two offenses in violation of the 93rd and 96th Articles of War, 10 USC §§ 1565, 1568. The specification of the first charge alleged that on the 5th day of March, 1951, he burglarized the dwelling house of Lieutenant General I. H. Edwards, with intent to commit a felony, to-wit: larceny, therein. The specification of the second charge stated that on the 9th day of March, 1951, he attempted to burglarize the dwelling house of Brigadier General M. J. Lee, with like intent. At the time…
