On November 10, 1910, the respondent, Julius Kasper, owned and conducted a merchandise store in the city of Colville, in this state, and on the day named, sold the same to the defendant, Hannah R. Cohn, taking from her as a part of the purchase price certain promissory notes aggregating $1,113.65. Mrs. Cohn entered into possession of the property and conducted the business until March 7, 1911, when she sold the same to the Colville Toggery, a corporation.
