MARGOLIS, Judge.

This case involves an alleged breach of contract by the United States acting through the Department of Housing and Urban Development (“HUD”). Plaintiffs, providers of low income housing under the Section 8 Housing Assistance Payments Program for New Construction and Substantial Rehabilitation, filed a complaint alleging that HUD had breached its Housing Assistance Payments Contracts (“HAP Contracts”) by failing to increase rents at the agreed rate.
