The named plaintiff, on behalf of herself, her minor children residing with her, and all persons similarly situated, has instituted this class action, civil rights suit for declaratory, monetary, and injunctive relief, contesting the practice and policy of the defendants, administrators of New York’s public assistance programs, of considering New York State Higher Education Services Corporation [HESC] loans as income for the purpose of determining medicaid eligibility.
