Cunningham v. Exon

The plaintiff, a citizen and taxpayer, brought this action against the defendant officials of the State of Nebraska for a declaratory judgment challenging the accuracy and validity of the proclamation, publication, and incorporation of an amendment to Article VII, section 11, of the Constitution of the State of Nebraska, adopted at a general election on November 2, 1976. The District Court sustained the defendants’ general and special demurrer upon the ground that plaintiff did not have standing to maintain the action, and dismissed plaintiff’s petition.
