RULING ON MOTION TO DISMISS
BLUMENFELD, District Judge.
The defendant Nicholson File Co. (Nicholson) has filed this motion to dis miss for want of subject matter jurisdiction pursuant to Rule 12(b)(1), Fed.R.Civ.P. Because I deem the issues raised to be in the nature of an affirmative defense rather than jurisdictional, I shall treat the motion as one for summary judgment pursuant to Rules 12(c) and 56(b), Fed.R.Civ.P. 1
