In this case Tom Lacy was convicted of violating the-prohibition law and comes here on appeal, alleging several grounds why the cause should be reversed and a new trial granted. At the close of the case when the state rested the defendant also rested and put in no-testimony and followed with a motion for an advised verdict, which was denied. He takes exceptions to instructions to the jury and alleges, a number of specifications of error as to the ruling on the admission or exclusion of testimony and other matters.
