MEMORANDUM OPINION AND ORDER

PIERSOL, Chief Judge.

In this proposed class action, Plaintiff, a Teamsters pension fund which owns stock in defendant Iowa Beef Packers, Inc. (“IBp”), to enjoin IBP and the other defendants from going forward with a proposed merger of IBP and an affiliate of defendant Donaldson, Lufkin & Jenrette (“DLJ”). Plaintiff has filed a Motion for a Temporary Retraining Order (“TRO”) and a Motion for Expedited Discovery.
