OPINION

BEVILACQUA, Chief Justice.

This is a civil action brought by the plaintiff, Harbor Marine Corporation, against Roy Briehler d/b/a Ferry Boat Inn and Restaurant, a party defendant, seeking to recover payment of $2,975.75 for work done in demolishing and removing the deteriorated portion of an A-frame and a collapsed ramp. The defendant, Briehler, interplead-ed the town of Jamestown, the lessor of the premises, as a third party, claiming that the town was responsible for the work done.

Prior to trial, Briehler submitted to a judgment in favor of Harbor Marine in the sum of $2,975.75,…
