This is an action in tort in which the plaintiff seeks to recover for bodily injuries and property damage sustained in a motor vehicle collision.

The reported evidence may be summarized as follows:1 At approximately 12:30 A.M. on March 14, 1983, plaintiff Maccarone was driving passenger James Lazzarino to the latter’s home in East Boston before proceeding to his-girlfriend’s house.
