Appeal from Circuit Court, Wood County. Suit for injunction by Bertha Morlang and others against the city of Parkersburg. Temporary injunction granted, defendant’s counter injunction dissolved, and temporary injunction made perpetual, and defendant appeals.

In the year 1878 one Fred It. Rose was the owner of a lot situate in the city of Parkersburg fronting 23 feet on the east side Market street, and extending back a distance of 90 feet. This lot is part of what is known on the original plat of the city as In-lot No. 92, and is between- what is mow known as Fourth street and Fifth street in said city, *511the north line of the same being at a distance- of 49 feet from the corner of said Market street and Fifth street.
