Defendant was indicted on three counts of murder (Ill. Rev. Stat. 1981, ch. 38, pars. 9 — 1(a)(1), (2)), and one count of voluntary manslaughter (Ill. Rev. Stat. 1981, ch. 38, par. 9 — 2(b)). The State entered a nolle prosequi on the voluntary manslaughter count before trial. At trial, both the defendant and the State tendered an instruction on voluntary manslaughter, and the State’s instruction was given to the jury which tried the case.
