The plaintiff, J. J. Theodore, by his original complaint in this action, commenced in the superior court for Yakima county on January 2, 1930, sought recovery from the defendant Washington Na tional Investment Company of eighteen bonds issued by the Northwestern Refrigerating Company, each evidencing a principal indebtedness of that company in the sum of fifty dollars; and also, in the alternative, a money judgment against the investment company for the value of the bonds in the event that delivery thereof cannot be had.
