The subject of discussion on this appeal is section 322 of the Civil Practice Act, and the practice to be followed under such section. By chapter 254 of the Laws of 1941, the Legislature repealed former sections 322 and 323, and in place thereof adopted the present section 322. The former sections read as follows: “ § 322.
