GARDNER, Circuit Judge.

This is an action for personal injuries, in which the appellant was plaintiff below. The parties will he referred to as they appeared in the lower court. In his amended petition, plaintiff alleged that on the 3d day of July, 1925, and for several months prior thereto, he was employed by the defendant in its chemical manufacturing plant in St. Louis, Mo., as a laborer; that under the orders and directions of the defendant he was engaged in operating a reduction tank, in which there was used strong, pungent, and poisonous acids; that, in the performance of his duties in…
