VAN DEVANTER, Circuit Judge.

This was an action to recover for personal injuries sustained by a brick mason through the tipping of a plank in a temporary scaffold provided as a working place for him. The evidence produced upon the trial, although somewhat contradictory, reasonably tended to establish these facts: The defendant, in whose service the plaintiff was, was erecting a brick cross-wall between two outer walls, already partially completed, which conveniently may be spoken of as the east wall and the west wall.
