This is an action for breach of a contract by which defendants insurance companies by their agent defendant Clinton E. Frank, Inc. undertook to “ sponsor ” certain television programs entitled “ ABC Evening Report ” on plaintiff’s television network and to pay plaintiff an agreed price therefor. At the end of the program of November 9, 1962, plaintiff caused to be broadcast a “ promotional announce*941ment ” of a program conducted by Howard K.
