This was an action for damages for personal injuries claimed to have been sustained by Carl F. Johnson, Jr., the plaintiff’s intestate, 1 by virtue of an accident which occurred on October 7, 1961, when the late Carl F. Johnson, Jr., was driving his automobile on Connecticut route 7 in the vicinity of Cornwall Bridge, Kent. The first count of the complaint, alleging a breach of warranty, was directed against the defendant, John Newell, doing business as Newell’s Atlantic Service Station, who was engaged in selling “new recapped tires” at retail.
