On April 27, 1935, one James W. Banta, a widower 82 years old, owned 83 acres of farm land in Jefferson County, Indiana, and on said day he conveyed the same by warranty deed to his son, Foster M. Banta. At the time of such conveyance the said James W. Banta had three other children, to-wit: Chester Banta, Emerson Banta and Evelyn Quail, who, with the said Foster M. Banta, were his sole and only heirs at law.
