Murray, hereinafter referred to as appellant, his wife joining him, brought suit in the court below for partition of 61 acres of land in Hamilton county, tíz. : The northeas t quarter of the northeast quarter of section 1, township 17 north, range 6'east (hereinafter referred to as the south 40 acres), and the southeast quarter of the southeast quarter of section 36, same township and range (hereinafter referred to as -the north 40 acres), except 19 acres off the north side thereof.
