The plaintiff and defendant claim title from a common source, under the will of Isaac Lytle, who died in March, 1823, having made his will about six months before his death. The rights of the respective claimants to the premises in dispute, depend upon the construction of the autographie will of a very illiterate man, ignorant not only of the several recognized estateTinTañcíj and of the technical rules relating to them, and the words necessary or appropriate to their creation, but also of the orthography and structure of the English language.
