This matter is before the Court on the cross motions of the parties for summary judgment. This adversary proceeding was filed by certain auto dealers known as “Auto Dealers Group” seeking a declaratory judgment as to whether they were liable to return to debtor the advance unearned commissions which they had received pre-petition.
