MAGRUDER, Chief Judge.

This is a somewhaat technical case, involving the application of Rule 14 of the Federal Rules of Civil Procedure, 28 U.S. C.A., as affected by the provisions of the Rhode Island statute governing contribution between joint tortfeasors.

The injured party and original plaintiff, Theodore Lauzier, a citizen of Massachusetts, filed his complaint in the United States District Court for the District of Rhode Island on March 29, 1956, against D’Onofrio Construction Company, Inc., a Connecticut corporation doing business in Rhode Island.
