1Opinion of the Court

LEVIN H. CAMPBELL, Circuit Judge.

New England Motor Rate Bureau, Inc. (“NEMRB”) petitions this court for review of a cease and desist order of the Federal Trade Commission (“FTC”). The opinion of the FTC in this case appears as New England Motor Rate Bureau, Inc., 112 F.T.C. _, Docket No. 9170, slip op. (Aug. 18, 1989). Our jurisdiction over this petition derives from 15 U.S.C. § 45(c).

At issue is whether Massachusetts’ supervision of motor carrier rates is sufficiently active to immunize NEMRB — the motor carriers’ private rate-making bureau — from the federal antitrust laws.
