OPINION
LATCHUM, District Judge.
In a one count indictment, defendant is charged with the unlawful possession of a sawed-off shotgun in violation of 26 U.S.C. § 5851 because the weapon had been made in violation of 26 U.S.C. § 5821 and had been transferred in violation of 26 U.S.C. §§ 5811, 5814. 1 Defendant has moved to suppress evidence on the ground that it is the fruit of a search incident to an unlawful arrest, and to dismiss the indictment on the ground that § 5851 violates his Fifth Amendment privilege against self-incrimination.
