Affirming.

Felix York and Robert Candill were tbe joint owners of a tract of land, consisting of 167.57 acres, on Mason’s Creek, in Perry county. After tbeir purchase of the land they made an oral partition thereof, each taking a particular balf. On November 30, 1906, York, for the recited consideration of $130.00, executed and delivered to Robert Caudill a ■ general warranty deed for bis balf of tbe land.
