KENT, District Judge.
Plaintiff S.A. Burns owns a beach house in Galveston, Texas which suffered flood damage caused by Tropical Storm Frances on September 11,1998. Defendant Federal Emergency Management Agency (“FEMA”) provided flood insurance on the beach house. Burns lodged a claim with FEMA for her damages, which FEMA paid in part.
