—Appeal from an order of Supreme Court, Erie County (Whelan, J.), entered May 31, 2001, which, inter alia, denied plaintiff’s cross motion for partial summary judgment on the claim under Labor Law § 240 (1).
It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by vacating that part of the sixth ordering paragraph granting defendants Esther Rosenfeld and Alan Rosenfeld, as executor of the estate of Harry Rosenfeld, deceased, summary judgment dismissing the claims under Labor Law § 240 (1) and § 241 (6) and reinstating those claims…
