Appeal by the plaintiff, Henry T. Goodwin, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Rockland on the 22d day of April, 1913, dismissing his complaint upon the decision of the court after a trial at the Rockland Special Term.

Thomas, J.:
The parties were married in the State of Illinois within one year after the entry of a judgment in the State of Colorado divorcing the defendant from a former husband. Later, in an action in the State of New York wherein each of the present parties sought a separation, it was found that they had intermarried in Illinois and that the man was the woman’s lawful husband and entitled to a judgment for separation.
