MEMORANDUM OPINION
BRIAN F. KENNEY, Bankruptcy Judge.
On remand from the Fourth Circuit Court of Appeals, this Court is called upon to set forth specific findings of fact — if the *219record so permits — in support of the Release, Exculpation and Injunction Provisions set forth in the Debtor’s Fourth Amended and Restated Plan of Reorganization. The Court sets forth its specific findings of fact herein, and concludes that these findings do not support the Release Provisions in this case.
