MEMORANDUM OPINION
ALEXANDER WILLIAMS, JR., District Judge.
Pending before the Court is Defendant Cape Environmental Management, Inc.’s Motion for Summary Judgment. Doc. No. 30. The Court has reviewed the motion papers and exhibits and concludes that no hearing is necessary. See Loe. R. 105.6 (D.Md.2011). For the reasons discussed below, Defendant’s Motion will be GRANTED.1
