KRAHULIK, Justice.
NBS Imaging Systems, Inc., (Appellee, Plaintiff below) ("NBS Imaging") seeks transfer after the Court of Appeals reversed the trial court and approved the offensive use of collateral estoppel by Vincent L. Tofany (Appellant-Defendant below) against NBS Imaging. Tofony v. NBS Imaging, Inc. (1992), Ind.App., 597 N.E.2d 28.
