HALL, C, J.

The appellee, Phillips, sued A. T. Barney and others to recover the amount of certain vendor’s lien notes and to foreclose the lien upon lands 'described in the petition. It was contended by the defendants that one note, in the sum of $145, executed by Barney to Phillips, represented usurious interest on the original notes sued upon. By agreement of all parties in open court only one issue was submitted to the jury as follows:
