No objection to the statement of the nature and result of the suit as given by the plaintiffs in error has been presented. It will accordingly be adopted and reads as follows:

“This suit was filed by N. H. Lipscomb on October 7, 1925, as plaintiff, against J. M. Mc-Nellis and wife, Plorence McNéllis, J. M. Loughry, Howard Mays, trustee, H. C. McCart, and William Monnig, defendants, for the collection of two notes, one for the sum of $15(1 due and payable two years after date, and one for the sum of $1,350 due and payable three years after date, both dated March 5, 1923, and bearing interest at…
