Steven Ewing appeals from the judgment of the district court dismissing his claim for damages resulting from a physician’s allegedly erroneous opinion regarding Ewing’s fitness to return to work. For reversal, Ewing claims the district court erred in granting summary judgment in favor of the appellee on the malpractice claim since genuine issues of material fact remain as to the existence of a physician-patient relationship.
