BUCKLEW, District Judge.
This cause comes before the Court for consideration of Defendant’s Motions for Partial Summary Judgment (Doc. Nos. 37 and 37A, filed July 21, 1997). Plaintiff filed a response on October 6, 1997 (Doc. No. 59).
Plaintiff Lora Harrell commenced this action on April 17, 1996 (Doc. No. 1), alleging that Defendant Diamond A failed to pay her a minimum wage in ’violation of the Fair Labor Standards Act of 1938, as amended, 29 U.S.C. § 201, et seq.
