ORDER
CARR, District Judge.
Plaintiff The Andersons, Inc. brings this action against Defendant Consol, Inc. claiming breach of commitments and un derstandings, unjust enrichment, reasonable reliance, unconscionable conduct, and intentional and/or negligent misrepresentation. This court has diversity jurisdiction pursuant to 28 U.S.C. § 1332. Pending is defendant’s renewed motion for summary judgment pursuant to Fed. R.Civ.P. 56(c). For the following reasons, defendant’s motion shall be granted.
