This is a suit brought by the plaintiff in error in the District Court in Fremont County to recover possession of certain mining ground, and for an injunction to restrain the defendants from further interfering with the premises, and from filing or recording any instruments of writing affecting the title to the same. The petition also asks for damages and that the plaintiff’s title to the lands in controversy be quieted in him as against any claim as*28serted by the defendants or either of them.
