Plaintiff Cordelia Smith filed this lawsuit in Arizona Superior Court on October 9, 2001. On November 8, 2001 Defendant Allstate filed a notice of removal with this Court (doc. # 1) claiming federal diversity jurisdiction pursuant to 28 U.S.C. § 1332. Thereafter, Allstate filed a motion to dismiss for failure to state a claim (doc. # 2). Smith then filed a motion to remand the action to state court (doc. # 4).
