This is an action on the case in which the declaration consists of three counts in each of which it is alleged that plaintiff was in the exercise of due care in driving his car along the state highway known as Route 4 between the Village of Elkhart and the City of Lincoln, said highway having a concrete surface 18 feet wide with earth shoulders on either side thereof 6 feet in width. The negligence charged in the first count in substance is that on the 19th day of September, 1929, about 2 hours after sunset and at the hour of 9 o’clock the defendant negligently permitted a large motor bus or…
