William C. Carter, plaintiff in error was informed against for the crime of murder, alleged to have been committed by killing A. Leavitt, by shooting him with a pistol. Upon his trial the jury returned a verdict finding him guilty of manslaughter in the first degree and assessing his punishment at imprisonment in the penitentiary for the term of four years. From the judgment rendered upon the verdict he appeals.
