Plaintiff in error, Henry Addington, hereinafter referred to a's the defendant, was convicted of manslaughter in the district court of McCurtain county on an information filed in said court on February 6, 1911, charging him with the murder of Boliver McWhorter, in said county, on or about December 18, 1910, and in accordance with the verdict of the jury was sentenced to serve a term of ten years’ imprisonment in the state penitentiary.
