I. Introduction.

The plaintiff, Alvin Underwood (“Underwood”), originally filed this insurance fraud action against Life Insurance Company of Georgia (“Life of Georgia”) in the Circuit Court of Greene County, Alabama, on or about February 28, 1997. Underwood asserted claims, pursuant to the laws of the State of Alabama, for misrepresentation, fraudulent suppression, fraud by mistake, negligent supervision, and wanton supervision.
