Whitley sued to recover from White $20,452.39, which Whitley claimed as his share of commissions on sales made by Whitley and White of asphaltic limestone for the Alabama Asphaltic Limestone Company, under an agreement by which White was to receive 50c and Whitley $1 per ton on all such of this paving’ material as they might sell for use on Georgia Highway projects.
