Pending before the Court is Defendant City of Corpus Christi Independent School District’s Motion for Summary Judgment. (D.E. 16.) For the reasons stated herein, Defendant’s motion is DENIED IN PART and GRANTED IN PART, as detailed below.

I. Jurisdiction

The court has federal question jurisdiction over the plaintiffs case under 28 *649U.S.C. § 1331 as Plaintiff brings claims under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. (“Title VII”) and the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq.
