There-is presented by the record in this case only one major question for decision. The widow of Alston made application to the department of industrial relations for compensation under the workmen’s compensation act, for his death, alleging that at the time of the injury, which resulted in death, he was in the employ of Swift & Company. This position was opposed by Swift & Company, they contending that he was not in any way employed by them, but was an employee of one Oliver, who was an independent contractor.
