This was an action to set aside a contract for settlement of a partnership. The trial court sustained defendant’s demurrer to plaintiff’s evidence. The plaintiff has appealed.

The two defendants are for all practical purposes one and the same and will be so treated in this opinion. The petition alleged that defendant Aylward in 1941 was a man of means and engaged in many enterprises in the oil business. The plaintiff had considerable experience in salvaging oil properties.
