Plaintiffs earlier motion for partial summary judgment was granted, and judgment was entered against three of the defendants (Braddock Management, L.P.; Bainbridge Management, L.P.; and Bainbridge Management, Inc. — collectively “the Management Companies” or “Defendants”) 1 on the issue of liability under three counts of the complaint — Count I, breach of fiduciary duty; Count XI, breach of contract; and Count XII, indemnification.
